COMMERCIAL & COMPETITION

The Commercial & Competition Department of WAN Avocats assists companies, executives, and shareholders with all issues relating to business life, commercial relations, and competition law, both at the national and European levels.

Our team provides advisory, pre-litigation, and litigation support before civil, commercial, and administrative courts, as well as before national and European competition and regulatory authorities (DGCCRF, French Competition Authority, European Commission, General Court, and Court of Justice of the European Union).

Our areas of intervention include:

• Contractual and commercial disputes: non-performance or wrongful termination of contracts, debt recovery, contractual liability, nullity of agreements;

• Shareholder and corporate disputes: enforcement or breach of shareholders’ agreements, abuse of majority or minority rights, exclusion procedures, directors’ liability;

• Unfair competition and restrictive practices: economic parasitism, disorganization, confusion, diversion of clients, disparagement;

• Competition, Antitrust & EU Law: merger control, anticompetitive practices, preliminary ruling questions, complaints and appeals before EU institutions;

• Proceedings before administrative and regulatory authorities (DGCCRF, DDPP, French Competition Authority, European Commission) involving commercial, competition, and consumer protection matters.
